Terms of Service

Last updated: October 15, 2026

Effective date: October 15, 2026

These Terms of Service ("Terms") are an agreement between you and Openfire LLC DBA Mintwell ("Mintwell," "we," "us" or "our"). They cover the Mintwell app at app.mintwell.ai, our website, the work-optional check, the Mintwell app in ChatGPT, and the emails we send (together, the "Services"). Our Privacy Policy explains how we handle personal information.

The short version

  • Mintwell's plans are estimates for education, not investment, tax or legal advice.
  • Advisors are responsible for the advice they give and for following the rules of their profession.
  • You keep ownership of your information. We use it only to run the Services, as the Privacy Policy explains.
  • Accounts for people planning on their own are free. Advisors pay a subscription they can cancel from the Billing page.

1. Agreeing to These Terms

By creating an account or using the Services, you agree to these Terms. If you don't agree, please don't use the Services. You must be at least 18 years old. If you use the Services for a business or firm, you confirm that you're allowed to accept these Terms for it, and "you" includes that business.

2. What Mintwell Does

Mintwell helps people see when work could become optional, and helps financial professionals plan with their clients. The Services include:

  • For advisors: client plans, client invitations, a work-optional check for their website, lead alerts and follow-up emails, team accounts for assistants and managing directors, and an optional listing in the Mintwell advisor directory.
  • For advisors' clients: a login to see their plan, send updates and questions, and keep their plan if they stop working with their advisor.
  • For people planning on their own: the free work-optional check, free self-managed accounts, the Mintwell app in ChatGPT, and the option to ask an advisor from the directory for help.

We may add, change or remove features over time. If we remove something you pay for, we'll tell you first.

3. Education, Not Advice

Mintwell is not an investment adviser, broker-dealer, tax preparer or law firm, and the Services don't provide investment, tax or legal advice. Plans, statuses and "ways to get On Track" are estimates based on the numbers given and on assumptions about growth, inflation, taxes and Social Security. Real results will differ, and nothing in the Services is a guarantee.

AI features can make mistakes, so review what they find before relying on it. The advisor directory lists advisors who choose to join; a listing isn't a recommendation or endorsement, and you decide whether to work with any advisor. Before making financial decisions, consider talking with a qualified professional.

4. Accounts

  • Give accurate information and keep it up to date.
  • Keep your password private and use a strong, unique one, or sign in with Google.
  • Each login is for one person. Advisors add assistants and managing directors as team members with their own logins instead of sharing theirs.
  • Tell us right away at support@mintwell.ai if you think someone has used your account without permission.
  • You're responsible for what happens under your account.

5. For Advisors

If you use Mintwell as an advisor or on an advisor's team, you also agree that:

  • You hold the licenses and registrations your work requires, and you follow the laws and rules that apply to you, including those on advice, communications, recordkeeping and client privacy.
  • You're responsible for the advice you give your clients. Mintwell is a tool to support that work, not a substitute for your professional judgment.
  • You have your clients' permission to share their information with Mintwell, including for documents you have Mintwell read, and you meet your own privacy obligations to them.
  • Emails Mintwell sends on your behalf (invitations, plan links, results and follow-ups) go only to people who have asked to hear from you or are your clients, and you'll honor unsubscribe requests.
  • Your directory listing and profile are accurate.
  • For your clients and leads, you decide how their information is used, and Mintwell handles it on your behalf, as the Privacy Policy explains.

The benchmark

Mintwell can show your clients how they compare with other people — “you save more than 8 in 10 owners your age”. That is only possible because advisors contribute to it, so contributing is on by default and you permit it here.

  • You permit Mintwell to count ranges drawn from your clients' and leads' answers into its benchmark, and to use that benchmark for its own services, including for other advisors' clients.
  • What is counted is only rates, ages and multiples turned into ranges. No dollar amount, name, email address, employer or account is ever included, and nothing counted can be connected back to a person. Section 5 of the Privacy Policy sets out exactly how.
  • This is a separate permission from the one above, where Mintwell handles your clients' information on your behalf and for your purposes. Here Mintwell uses it for its own, which is why it is stated here rather than assumed.
  • You can turn it off for your whole firm at any time in your settings, and your clients can opt out individually. Turning it off stops further counting; what has already been counted stays in the totals unless an individual opts out, because it holds nothing that identifies anyone.
  • You remain responsible for having your clients' permission, as above. If your own obligations to a client do not allow this, turn it off.

6. Subscriptions and Payment

  • Accounts for people planning on their own, and logins for advisors' clients, are free.
  • Advisor plans are paid subscriptions, billed in advance through our payment processor, Stripe, at the price shown when you subscribe.
  • A new advisor subscription may start with a free trial. Unless you cancel before the trial ends, it becomes a paid subscription and you're charged then.
  • Subscriptions renew automatically until you cancel. You can manage or cancel yours at any time from the Billing page. Canceling stops future charges, and you keep access until the end of the period you've paid for.
  • Payments aren't refundable unless the law requires it or we say otherwise when you buy.
  • We'll tell you before a price change takes effect, and you can cancel before it applies to you.
  • You're responsible for any taxes on your purchase, other than taxes on our income.

7. Your Information

You keep ownership of the information you put into Mintwell, and advisors and their clients keep ownership of client information. You give us permission to store, process and display it only to provide and secure the Services, as the Privacy Policy describes. We don't sell it or use it to train AI models.

You're responsible for having the right to share what you put into Mintwell. Please don't include Social Security numbers, full account numbers or passwords in notes, messages or uploads.

8. Acceptable Use

When using the Services, don't:

  • Break the law or help anyone else break it.
  • Enter or upload someone else's information without the right to do so.
  • Send spam, or use Mintwell's emails or forms to mislead people.
  • Try to get around limits, access accounts or data that aren't yours, or probe, scan or test the Services for weaknesses without our written permission.
  • Copy, scrape, resell or reverse engineer the Services, or use them to build a competing product.
  • Upload viruses or other harmful code, or overload or disrupt the Services.

If you find a security problem, please tell us at support@mintwell.ai.

9. Other Services

Some parts of the Services work with other companies' services, such as ChatGPT, Google sign-in, Stripe, and the booking pages advisors link to. Those services have their own terms and privacy policies, and we aren't responsible for them.

10. Mintwell's Property

Mintwell's software, design, text, graphics and name are owned by us or our licensors and protected by law. While you follow these Terms, we give you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. If you send us feedback or ideas, we may use them without owing you anything.

11. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Services will be uninterrupted, error-free or completely secure, or that any plan or estimate will be accurate.

12. Limitation of Liability

To the fullest extent the law allows, Mintwell won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or investment losses, arising from the Services or these Terms. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and $100. Some places don't allow these limits, so they may not all apply to you.

13. Responsibility for Claims

To the extent the law allows, you agree to defend and compensate Mintwell for claims, losses and costs (including reasonable legal fees) that come from your breaking these Terms or the law, or from information you put into the Services without the right to do so. For advisors, this includes claims about the advice you give and your dealings with your clients.

14. Ending Your Use

  • You can stop using the Services at any time. To close your account, contact us; advisors should cancel their subscription from the Billing page too.
  • Before closing an account, advisors can download their leads and plan figures as CSV files, and anyone can ask us for a copy of their information.
  • We may suspend or close an account that breaks these Terms or puts others at risk. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.
  • When an advisor's account closes, clients who have their own Mintwell login keep their plan as a self-managed account, as the Privacy Policy explains.
  • Sections that by their nature should continue (such as Education, Not Advice; Disclaimers; Limitation of Liability; and Responsibility for Claims) still apply after your use ends.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be decided in the state or federal courts located in Palm Beach County, Florida, and you and we agree to those courts' jurisdiction, unless the law where you live requires otherwise.

16. Changes to These Terms

We may update these Terms. We'll post the new version here and update the date at the top. For material changes, we'll also tell account holders by email or in the app before the changes take effect. If you keep using the Services after that, the new Terms apply.
